Loyalty Program Membership and Eligibility
These Loyalty Program terms – (“Loyalty Program Terms”) are Additional Terms under the Lemme Inc. Terms of Service and are subject to and governed by the Terms of Service, including without limitation our dispute resolution process. By signing up for our Loyalty Program (“Program”), or using any benefits or rewards made available from time to time thereunder (“Rewards”) you agree to be bound by these Terms. You must be eighteen (18) years of age or older to enroll in the Program (“age eligibility”) and have legal capacity to enter into a binding agreement.
BY APPLYING FOR MEMBERSHIP IN THE PROGRAM, YOU AGREE YOU HAVE AGE ELIGIBILITY AND LEGAL CAPACITY TO BE BOUND BY THESE LOYALTY PROGRAM TERMS. NO PURCHASE IS NECESSARY TO JOIN THE PROGRAM.
Lemme reserves the right to change or modify any Rewards available on its Loyalty Program Page on Lemme’s website from time to time at any time, without notice, and in its sole discretion. Lemme reserves the right to update or modify these Loyalty Program Terms at any time at its sole discretion. If Lemme decides to change these Loyalty Program Terms, Lemme will post a new version on the Lemme website and update the date set forth above. Lemme will not be liable to you in the event of any modification, suspension, or discontinuance of the Program. Continued participation in the Program after any modification shall constitute consent to such modification.
Earning and Redeeming Rewards
All members of the Program may enjoy a variety of Rewards from time to time. Opportunities to earn Rewards may differ for subscriber and non-subscriber customers (“Reward Tiers”), and subscriber customers may have more opportunities to earn rewards than non-subscriber customers.
Program Members will earn:
- 1 point for every $1.00 USD spent on qualifying purchases on Lemme’s website excluding taxes and shipping;
- 20 points for creating an account;
- 5 points for following Lemme on Instagram and TikTok (5 points for each);
- 50 points for spending over one hundred dollars $100.00 USD on Lemme’s website;
- 20 points for making a first referral to another customer via a referral code or link who purchases a Lemme product via such referral code or link; and
- 30 points for making a third purchase on Lemme’s website.
The type, timing and availability of any Rewards, special offers, sweepstakes, advance access, exclusive events or experiences will be determined by Lemme in its sole discretion and may be updated from time to time on the Loyalty Program Page on Lemme’s website, elsewhere on Lemme’s website, or as otherwise communicated to members via email or other form of communication.
Members may redeem points to purchase products on Lemme’s website as set forth on the Loyalty Program Page on Lemme’s website. Points will not apply to shipping or handling charges or taxes.
Lemme may, in its sole discretion, alter, limit, or modify the rules, regulations, benefits, eligibility for membership, or any other feature of a particular Reward Tier or may terminate a particular Reward Tier at any time in its sole discretion, without prior notice except as expressly required by applicable law.
Restrictions and Termination
In addition to the restrictions you agreed to in Lemme’s Terms of Service, you agree that the following activities are expressly prohibited and your engagement or suspected engagement in any of these will be grounds for immediate termination and disqualification from the Program and may lead to the forfeiture of existing referral codes or links and Rewards accrued, but not yet used, as well as termination or suspension of your Lemme account at Lemme’s sole discretion:
- Spam, bulk distribution, distribution to strangers, or any other promotion of referral codes or links, any other actions that would constitute or appear to constitute unsolicited commercial e-mail or spam under any applicable law or regulation, posting or sharing referral codes or links on any sites or elsewhere, or otherwise making a referral code or link available to anyone you do not personally know prior to providing the referral code or link.
- Fraud, attempted fraud, or abuse of the Program or Loyalty Program Terms.
- Selling, trading, bartering, or providing anything of value to your referee beyond the referral code or link, or otherwise using Rewards for promotional purposes.
- Sending more than one referral code or link to the same recipient or creating false referee accounts to attempt generate additional referral Rewards.
- Any other abuse, as determined by Lemme in its sole discretion.
Limitations and Conditions
The following limitation and conditions apply to the Program and use of Rewards:
- The Program may not be combined with other offers or promotions unless specified otherwise.
- Rewards are non-transferable, non-exchangeable, and cannot be redeemed for cash.
- Referral Rewards must be used within 90 days of accrual.
- Referral Rewards are capped at $1000.00 USD in value in any 12-month period.
- Lemme reserves the right to verify the eligibility of Members and to modify, suspend or terminate the Program at any time without prior notice, at its sole discretion.
- Lemme may set expiration dates for the use of a Reward or referral code or link or otherwise limit such Reward or code or link. Rewards will expire upon the cancellation of your Lemme account.
- You are solely responsible for any taxes incurred by you relating to the receipt of Rewards.
Opting Out of the Loyalty Program
By creating a Lemme Account, you are joining Lemme’s Loyalty Program. You can withdraw from Lemme’s Loyalty Program by emailing privacy@lemmelive.com. Please note that if you withdraw, you will no longer accrue any points and you will forfeit any points you have accrued and be ineligible to redeem them for Rewards.
Additional Terms
By enrolling in the Program, you agree to be bound by Lemme’s Terms of Service, Terms of Sale, Privacy Policy, and Consumer Health Data Privacy Policy, as applicable.
